Internet Banking Agreement
1) Internet Banking is an Access Option to perform inquiries, withdrawals or transfers on your account(s) by electronic technology. Your rights and responsibilities concerning your account(s) are covered by your Membership and Account Agreement, your Truth-in-Savings Rate and Fee Disclosure and our Privacy Policy. Internet Banking also provides access to Bill Pay Services with your rights and responsibilities disclosed in the Bill Pay Agreement.
2) Definitions: In this Agreement the words “you” and “your” means the account owner who signs this agreement. The words “we”, “us”, and “our” mean the Credit Union. Password means the confidential identification code used for identification purposes in connection with the use of our Internet Banking Services. The word “Account” means those accounts which you may access by use of your password. User ID means your social security number. Business Day means every day except Saturday, Sunday and federal and state holidays. Electronic means electrical, digital, magnetic, wireless, optical or electromagnetic technology, or any other technology that entails similar capabilities.
3) Setup: Upon receiving your signed agreement, we will activate all of your accounts for access (all accounts having your social security number) and issue a first time password to you. This password will be mailed to your address. The first time you enter this password, you will be prompted to assign a new password. Upon assigning a new password, the previous password will not access your accounts. You will be the only person who knows your password. You should keep your password in a secure location. Any person knowing your social security number and your password will be able to access your accounts and perform all available transactions. You authorize us to honor transactions initiated by a third person to whom you have given your password even if you do not authorize a particular transaction. You may select a new password for your account access at any time. If you forget your password, we will have to reactivate your accounts and issue a new first time password.
4) Accessibility: Internet banking services are generally accessible 24 hours a day, seven days a week, except that Internet Banking Services may be inaccessible for a reasonable period on a periodic basis for system maintenance. We are not liable under this Agreement for failure to provide access due to a system failure or due to other unforeseen acts. We may modify, suspend, or terminate access to the Internet Banking Services at any time and for any reason without notice or refund of fees you’ve paid.
5) Equipment and Software Requirements: To use the Internet Banking Services, you need a computer with a modem and a web browser that supports 128 bit encryption (such as Netscape Navigator 4.0 or above; Microsoft Internet Explorer 4.0 or above; or an equivalent). You are responsible for the set-up and maintenance of your computer and modem. We are not responsible for any errors or failures from any malfunction of your computer or any virus or other problems related to the use of the Internet Banking Services.
6) Services Offered: You can use the Internet Banking Services to access all accounts that are linked to your social security number. At your request, you may remove access to any account (or sub-account) that has your social security number. Internet Banking Services allows you to perform inquiries on balances and recent activity, transfer funds between any of your accounts, transfer funds to another members account, request a Stop Payment for a check or range of checks, re-order additional checks in the same format as your last order from us, request a check copy or download account information to Quicken or Microsoft Money. You can use Internet Banking Services to access Bill Pay Services.
7) On-line Activity: Internet Banking Services provides on-line access to your accounts, with the exception of credit cards which are updated on a delayed basis (up to 48 hours). Your account balances are on-line and include all transactions that have been posted to your account up to that point in time (includes all teller, ATM/POS/VISA Debit Card and Internet Banking Services transactions). Internet Banking Transactions are on-line and immediately update your account balances and history, with the exception of your credit card accounts.
8) Parties’ Responsibilities: The respective rights and obligations of you and the Credit Union are established by Regulation E – Electronic Funds Transfer Act. Our Reg. E policy is provided to you along with this Internet Banking Agreement.
9) Password Notification: If you believe your password or account information has been obtained by an unauthorized party or that someone has transferred or may transfer money from your Account without permission, you will immediately call the Credit Union at: (623) 580-6000 or write Canyon State Credit Union at 3440 W. 10) Cancellation: Your Internet Banking Services remain in effect until terminated by you or us. You may cancel your Internet Banking Services at any time by notifying us by mail, by phone or at any one of our branch locations. We may terminate your participation in the Internet Banking Services for any reason, at any time. We will try to notify you in advance, but we are not obliged to do so.
11) Changes in Terms and Other Amendments: We may change or amend any part of this agreement at any time, including changes in terms, conditions, and fees, as long as we give you advance notice as required by law. Your continued use of this service constitutes acceptance of those terms and conditions. The terms of your other account agreements shall continue to apply.
12) Limit of Credit Unions and Other Providers’ Responsibility: The Credit Union agrees to make reasonable efforts to ensure full performance of our Online Banking Services. We will be responsible for acting only on those instructions sent through our Online Banking Services which are actually received and cannot assume responsibility for malfunctions in public communication facilities not under our control that may affect the accuracy or timeliness of messages you send. In the absence of negligence on the part of the Credit Union, neither the Credit Union nor any software supplier is responsible for any direct, indirect, special, incidental or consequential damages arising in any way out of the use of these services. Because some states do not allow the exclusion or limitation of liability for incidental or consequential damages, in such states the liability of the Credit union or software suppliers is limited to the extent permitted by law. NEITHER THE CREDIT UNION NOR ANY SOFTWARE SUPPLIER MAKES ANY EXPRESS OR IMPLIED WARRANTIES CONCERNING THE CREDIT UNION’S ONLINE BANKING SOFTWARE OR SERVICES INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTY PROPRIETARY RIGHTS UNLESS DISCLAIMING SUCH WARRANTIES IS PROHIBITED BT LAW. Should any one or more provisions of this Agreement be determined illegal or unenforceable in any relevant jurisdiction, then such provision may be modified by the proper court, if possible, but only to the extent necessary to make the provision enforceable, and any such modification shall not affect any other provision of this Agreement.
Further we will not be liable for losses:
1) If your telephone, PC, or Online Banking Services were not working properly and the equipment failure should have been apparent to you when you attempted to authorize a transaction.
2) If you have not given us complete, accurate or current account numbers or other identifying information so the credit union can properly complete a transaction.
3) If you have not properly followed the Online Banking Services instructions or have provided us with wrong or inaccurate information.

13) Governing Law: This Agreement is made in Arizona and shall be governed by the laws of the State of Arizona to the extent that Arizona Law is not inconsistent with controlling Federal Law.

15) Acceptance of Agreement: You understand that by signing this agreement, using or continuing to use the service, you agree to the terms and conditions of this agreement.
