ATM and MasterCard Debit Card Agreement

  1. An ATM or MasterCard Debit Card is an Access Option to perform inquiries, withdrawals or transfers on your account(s) and your rights and responsibilities concerning your account(s) are covered by your Membership and Account Agreement.
  2. In this Agreement the words “you” and “your” means each account owner. The words “we”, “us”, and “our” mean the Credit Union. The word “PIN” means your Personal Identification Number. The word “Account” means those accounts which you may access by use of your Card or your Card and PIN. Card means either an ATM Card or MasterCard Debit Card.
  3. Card ownership: The Credit Union will issue a PIN and an ATM or MasterCard Debit Card to you. The Card remains the property of the Credit Union. The Credit Union may terminate your right to use the Card at any time for any reason without notice. Upon demand by the Credit Union, you will immediately return the Card(s) to the Credit Union.
  4. Transactions: The Card with your PIN can perform transactions at ATM machines, Point of Sale (POS) terminals and any other electronic terminal (all hereinafter referred to as Machine) as determined by the Credit Union. In addition, the MasterCard Debit Card can perform “MasterCard” transactions at any merchant that honors MasterCard worldwide. Such transactions shall be subject to such limitations on dollar amounts and frequency of use as the Credit Union, in its sole discretion may determine. You authorize us to honor transactions initiated by a third person to whom you have given your Card and PIN, even if you do not authorize a particular transaction.
  5. Refusal to Honor the Card: The available machines may be changed by the Credit Union at any time without prior notice to you. In addition, even though your account may have a balance sufficient to cover a requested transaction, the Machine, merchant, and others who accept the Card may not be able to determine your actual balance. Therefore, the Credit Union is not liable for the retention of your card or for the refusal or inability of such machines or persons to honor the Card or to complete the transaction.
  6. Card Withdrawals: Card withdrawals with the exception of ATM transactions, will be charged against your checking account. The Credit Union cannot honor stop payment requests on Card Withdrawals. The MasterCard Debit Card may not be used in conjunction with any activity prohibited by law, such as Internet Gambling. Any transactions attempting to clear your account that are identified as unlawful may have payment refused at the Credit Union’s discretion.
  7. Transaction slips: A transaction slip will be provided to you by the Machine or merchant when the transaction is performed. The monthly statement of account will identify the merchant, financial institution or electronic terminal at which transactions were made; but sales, cash advances, credit or other slips cannot be returned with the statement.
  8. Deposits: Any deposit receipts issued by a Machine are subject to verification and amendment by the Credit Union to effect reconciliation of funds actually received. Deposit availability will be subject to the Credit Union’s Funds Availability Policy.
  9. FOREIGN TRANSACTIONS: Card Withdrawals made in foreign countries and foreign currencies will be charged to your Account in U.S. Dollars. The conversion rate to dollars will be made at a rate selected by MasterCard from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate MasterCard itself receives, or the government-mandated rate in effect for the applicable central processing date, in each instance, plus or minus any adjustment determined by the Issuer in accordance with the Operating Regulations for International transactions established by MasterCard International, Inc., through whose facilities Card Withdrawals are handled.
  10. RETURNS AND ADJUSTMENTS: Merchants and others who honor the Card may give credit for returns or adjustments. They will do so by initiating a credit to the Credit Union, which will credit the amount to your Account.
  11. LOST CARD NOTIFICATION: If you believe the Card, the account number, the PIN or any combination of the three has been lost or stolen or that someone has transferred or may transfer money from your Account without permission, you will immediately call the Credit Union at: (623) 580-6000 or write Canyon State Credit Union at 3440 W. Deer Valley Road, Phoenix, AZ 85027. You may be charged a recovery fee if you and/or your joint owner(s) use MasterCard Card(s) that have been reported lost or stolen.
  12. LIABILITY FOR UNAUTHORIZED USE: You understand that your total liability to the Credit Union, or responsibility for Card Withdrawals made from your Account, resulting from the loss, theft or other unauthorized use of the Card, account number on the Card, the PIN or any combination of the three shall, shall be governed by applicable law:
    1. MasterCard Transactions – Your MasterCard Debit Card has zero ($0) liability for unauthorized signed MasterCard transactions from someone using your lost or stolen Card(s), unless you have been grossly negligent or have engaged in fraud.
    2. Transactions performed with the Card and PIN are governed by Regulation E – Electronic Funds Transfer Act.
  13. All provisions of this Agreement are subject to change by the Credit Union, at its sole discretion, after written Notice to you at your latest address shown on the records of the Credit Union. You are not bound by the provisions of the Amended Agreement set forth in the Notice, provided you immediately cease to use the Card and return the Card to the Credit Union. Your retention and continued use of the Card after Notice shall constitute agreement to all matters included within the Notice.
